Storage duration

Information on data transfer to the USA and other non-EU countries

Among other things, we use tools of companies domiciled in the United States or other from a data protection perspective non-secure non-EU countries. If these tools are active, your personal data may potentially be transferred to these non-EU countries and may be processed there. We must point out that in these countries, a data protection level that is comparable to that in the EU cannot be guaranteed. For instance, U.S. enterprises are under a mandate to release personal data to the security agencies and you as the data subject do not have any litigation options to defend yourself in court. Hence, it cannot be ruled out that U.S. agencies (e.g., the Secret Service) may process, analyze, and permanently archive your personal data for surveillance purposes. Right to data portability

Google Forms enables us to generate online forms to record messages, inquiries and other entries entered by visitors to our website. All entries you make will be processed on Google’s servers. Google Groups

The Google Group we have created allows emails sent to scmmanager@googlegroups.com to be distributed to all email addresses of its members, after prior moderation by the “SCMM” working group. We want to create an offer to provide quality support to our users or to inform them about content related to our products/SCM Manager. A special feature is that e-mails sent to the distribution list are publicly viewable in the group's archive. The address of the mailing list is groups.google.com/g/scmmanager.

You can use the mailing list as a non-member as well as a member, in both cases the terms of use and privacy policy of Google apply.

As a non-member, you can send messages to the mailing list yourself and view the public archive of the mailing list via the address given above. If a message sent by you is delivered to the members of the mailing list after successful moderation, it is now publicly viewable including sender, e-mail address and content.

As a member you can, beyond the possibilities of a non-member, automatically receive e-mails that have been previously “moderated” by the SCMM working group as well as make your own settings for your membership at groups.google.com.

We maintain publicly available profiles in social networks. The individual social networks we use can be found below.

Social networks such as Github, Twitter etc. can generally analyze your user behavior comprehensively if you visit their website or a website with integrated social media content (e.g., like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered. In detail:

If you are logged in to your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data may also be recorded if you are not logged in or do not have an account with the respective social media portal. Responsibility and assertion of rights

If you visit one of our social media sites (e.g., GitHub), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. Analysis tools and advertising

Matomo

This website uses the open-source web analysis service Matomo.

Through Matomo, we are able to collect and analyze data on the use of our website-by-website visitors. This enables us to find out, for instance, when which page views occurred and from which region they came. In addition, we collect various log files (e.g., IP address, referrer, browser, and operating system used) and can measure whether our website visitors perform certain actions (e.g., clicks, purchases, etc.).

Google Ads

The website operator uses Google Ads. Google Ads is an online promotional program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display ads in the Google search engine or on third-party websites, if the user enters certain search terms into Google (keyword targeting). It is also possible to place targeted ads based on the user data Google has in its possession (e.g., location data and interests; target group targeting). Newsletter data

In order to inform you about product news, current offers and the like, we offer the possibility to register for our newsletter. If you would like to receive the newsletter offered on the website or during registration, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and agree to receive the newsletter. Further data is not collected or only on a voluntary basis.

For registration, we use the double opt-in procedure to ensure that you subscribe to the newsletter personally. In the double opt-in process, we send you an e-mail to the specified e-mail address after you have subscribed to the newsletter with a link to confirm that you wish to receive the newsletter. This ensures that no one can register with a foreign e-mail address. When you register for the newsletter, the following personal data is stored:

  • E-mail address
  • if applicable, your first and last name, if you provide this voluntarily
  • IP address
  • Date and time of registration

We log the data for the future dispatch of the newsletter and to protect our legitimate interest in being able to prove your registration. If the receipt of the newsletter is not confirmed, your registration / your data will be automatically deleted after 1 week.

For the processing of the newsletter, we use the newsletter service provider CleverReach.

CleverReach

We use CleverReach to send newsletters. The provider is CleverReach GmbH & Co. KG, Schafjückenweg 2, 26180 Rastede, Germany (hereinafter: “CleverReach”). CleverReach is a service with which the newsletter dispatch can be organized and analyzed. The data you enter for the purpose of receiving newsletters (e.g., e-mail address) is stored on CleverReach's servers in Germany or Ireland.

In order to be able to send you newsletters that correspond to your interests, we would like to analyze the use of our e-mail newsletter - for example, whether you opened the newsletter or whether certain links were clicked.

Our newsletters sent with CleverReach allow us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g., purchase of a product on this website) has taken place after clicking on the link in the newsletter. We track the use of the e-mail newsletter exclusively according to your consent to receive the newsletter, which we request when you register for the newsletter. We use the data to continuously improve the quality of the newsletter and, if necessary, to tailor content and offers to you.

The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time by unsubscribing from the newsletter. For this purpose, you will find a link for unsubscribing at the end of each newsletter. You can also unsubscribe from the newsletter at any time by sending an informal email to datenschutz@cloudogu.com.

If you do not want CleverReach to analyze your data, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link or button in each newsletter message.

The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter or the newsletter service provider and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter. Your data for the newsletter dispatch will be deleted within 3 months after termination of the newsletter receipt, provided that the deletion does not conflict with any legal retention obligations. Data that has been stored by us for other purposes remains unaffected by this.

After you have unsubscribed from the newsletter distribution list, your e-mail address will be stored by us or the newsletter service provider in a blacklist, if necessary, to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) f DSGVO). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

Online-based Audio and Video Conferences (Conference tools)

Data processing

We use online conference tools, among other things, for communication with our customers. The tools we use are listed in detail below. If you communicate with us by video or audio conference using the Internet, your personal data will be collected and processed by the provider of the respective conference tool and by us. The conferencing tools collect all information that you provide/access to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” related to the communication process (metadata).

Furthermore, the provider of the tool processes all the technical data required for the processing of the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

Should content be exchanged, uploaded, or otherwise made available within the tool, it is also stored on the servers of the tool provider. Such content includes, but is not limited to, cloud recordings, chat/ instant messages, voicemail uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have complete influence on the data processing procedures of the tools used. Our possibilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, and which we have listed below this text.

Purpose and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest in the meaning of Art. 6(1)(f) GDPR). As far as consent has been requested, the tools in question will be used based on this consent; the consent may be revoked at any time with effect from that date.

Duration of storage

Data collected directly by us via the video and conference tools will be deleted from our systems immediately after you request us to delete it, revoke your consent to storage, or the reason for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal retention periods remain unaffected.

We have no influence on the duration of storage of your data that is stored by the operators of the conference tools for their own purposes. For details, please directly contact the operators of the conference tools.

Custom services

Handling of business cards

In the course of exchanging business cards, we obtain access to the personal data provided by you via the business card. We use the information on your business card for the purposes of communication and follow-up of the contact. If during the conversation (exchange business card) you requested that we send you information about our products and services, we will send you the information about our company on the contact details of your business card. If there is no further exchange, or you do not respond to our contact and follow-up, we will delete your data (business card) within 1 year. You have the right to request the deletion of your data at any time - please send us an informal e-mail to datenschutz@cloudogu.com.

Community

On our website you can find a link to our community website community.cloudogu.com. There it is possible to create posts in the website community or to comment on the posts of other users with the personal data provided during registration (especially username). If you use this function of our website, your username will be visible for other users in your community postings.

The legal basis for the processing of the data is also the contract of use concluded with you during registration. The data use is intended for the fulfillment of this contract or the implementation of precontractual measures. The legal basis for the processing of the data is therefore Art. 6 (1) (b) GDPR.

A further legal basis for the use of your data is Art. 6 (1) (f) GDPR. The disclosure of the data in the community is intended on the one hand for the identification of the respective authors of each posting and on the other hand for the security of the community (e.g. by identification and documentation of authorship in the event of potentially illegal postings). These purposes also constitute our legitimate interest in data processing in accordance with Art. 6 (1) (f) GDPR.

The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. In the event that personal data transmitted by you during registration is disclosed in our community, the erasure of the postings provided by you takes place as soon as you have deregistered from our website.

Since we are always making an effort to minimize data use in accordance with the requirements of the applicable data protection provisions, we ask you not to provide personal data such as names, email addresses or phone numbers in community postings you make. To ensure data minimization, postings that include personal data will be erased by our community moderators without comment. We ask for your understanding in this regard.

Handling applicant data

We offer website visitors the opportunity to submit job applications to us (e.g., via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing, and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g., contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 BDSG according to German Law (Negotiation of an Employment Relationship), Art. 6(1)(b) GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6(1)(a) GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who participate in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 BDSG and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6(1)(a) GDPR) or if statutory data retention requirements preclude the deletion.

Admission to the applicant pool

If we do not make you a job offer, you may be able to join our applicant pool. In case of admission, all documents and information from the application will be transferred to the applicant pool in order to contact you in case of suitable vacancies.

Admission to the applicant pool is based exclusively on your express agreement (Art. 6(1)(a) GDPR). The submission agreement is voluntary and has no relation to the ongoing application procedure. The affected person can revoke his agreement at any time. In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal reasons for storage.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.
